What is a grace period for rent?

A grace period is the few days after rent is due when a tenant can still pay without a late fee. Rent is still due on the due date. The grace period just delays the fee.

In a little more detail

A lot of tenants get paid on a schedule that doesn't line up exactly with the 1st of the month. A short grace period gives them room without the landlord giving up on getting paid on time.

Whether you have to offer one depends on where the property is. A few states require a grace period by law. Everywhere else, it's up to the lease.

A simple example
  • Rent is due on the 1st with a 3-day grace period.
  • Paid on the 3rd: on time as far as fees go.
  • Paid on the 5th: the late fee applies.

Things to watch

  • A grace period doesn't move the due date. Say so in the lease.
  • Check whether your state sets a minimum.
  • If you use autopay, set it to run on the due date, not the end of the grace period.

Check your state's rules

See the official landlord-tenant law and guide for your state, and get a free lease kit by email.

This is a plain-English explanation, not legal advice. Rules vary by state and city, so check your local law or talk to an attorney before you act on it.
